Terms of Service Effective Date: 6 June 2026 Last Updated: 6 June 2026 Welcome to Untagged These Terms of Service ("Terms") govern your access to and use of the Untagged website, app, platform and related services (together, the "Platform" or "Services"). Untagged is a community-driven fashion marketplace where users can borrow and lend clothing and accessories. By using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
About Untagged Untagged is an online marketplace that allows users to list, discover, borrow and lend fashion items. Untagged’s mission is to make fashion more circular, accessible and sustainable by enabling people to share their wardrobes and earn income from items they are not currently using. Unless expressly stated otherwise, Untagged acts only as the provider of the marketplace platform. Untagged does not usually own, manufacture, inspect, warehouse, or insure the items listed by users, and Untagged is generally not a party to the rental contract entered into between a borrower and a lender. Where Untagged provides its own services directly to users—such as payment facilitation, customer support, account services or platform functionality—those services are provided by Untagged under these Terms.

Eligibility To use Untagged, you must: • Be at least 16 years old • Have the legal capacity to enter into a binding contract • Comply with these Terms and all applicable laws If you create an account or use the Platform on behalf of a business, you confirm that you have authority to bind that business to these Terms.
Account Registration To access certain parts of the Platform, you may need to create an account. You agree to: • Provide accurate, complete and up-to-date information • Keep your account login details secure and confidential • Promptly update any information that changes • Accept responsibility for all activity under your account Untagged may suspend or close accounts where we reasonably believe: • Information is false or misleading • The account is used fraudulently or unlawfully • A user has breached these Terms • Suspension is necessary to protect Untagged, users or the public
Nature of the Marketplace and User Status 5.1 Lenders Lenders on Untagged may be: • Private individuals / non-traders • Traders acting for business purposes Lenders must accurately declare their status and keep it up to date. 5.2 Consumer Law Notice Where a lender is a non-trader, the borrower is entering into a contract with another consumer. EU consumer protection rights may not apply. Untagged will clearly indicate this. 5.3 Trader Lenders Trader lenders are responsible for complying with all applicable consumer laws.
How Untagged Works 6.1 Lenders Lenders may create listings for permitted fashion items and are responsible for: • Legal right to list items • Accurate descriptions and images • Listing correct details (size, condition, etc.) • Pricing, availability and care instructions • Ensuring items are safe, clean and lawful 6.2 Borrowers Borrowers must: • Review listings carefully • Pay all amounts due • Use items responsibly • Return items on time and in agreed condition 6.3 Untagged’s Role Untagged facilitates the platform but does not control the items or guarantees associated with them.
Search Results and Ranking Listings may be ranked based on: • Relevance • Availability • Pricing • Listing quality • Location • User ratings • Promotional placement
Fees, Payments and Checkout Fees Untagged may charge: • Service fees to Borrowers • Commission fees to Lenders • Other charges disclosed before checkout Obligation to Pay By confirming a booking (e.g., “Pay Now”), you agree to pay. Payments Payments may be processed by Untagged or third-party providers. Payouts Lender payouts are released according to platform rules.
Security Deposits, Damage and Loss Untagged may offer or facilitate: • A security deposit • A pre-authorisation or hold • Item protection options • A damage claims process Where a security deposit applies, the Borrower acknowledges and agrees that: • The deposit may be retained in full or in part where an item: o Is not returned to the Lender o Is returned late o Is returned in a damaged, excessively soiled, or significantly altered condition beyond normal wear and tear • In cases where an item is not returned or is returned in poor condition, the Borrower may be liable for: o Repair costs o Cleaning costs o Replacement value or fair market value o Any applicable late fees o Any additional loss reasonably attributable to the Borrower’s breach Lenders must provide fair and reasonable evidence to support a claim, such as: • Photographs before and after rental • Repair estimates • Proof of replacement cost • Courier or return records Untagged may review and assist with claims. However, unless expressly stated, Untagged: • Does not guarantee recovery of any damage amount • Does not insure all transactions by default
Cancellations, Returns and Refunds • A separate policy may apply • Consumer rights apply to trader transactions • Non-trader rentals follow listing-specific rules
Item Condition, Cleaning and Care Lenders must provide clean, wearable items. Borrowers must: • Not alter or damage items • Not sub-lend items • Use items lawfully and responsibly
Prohibited Listings and Conduct Not permitted: • Counterfeit items • Illegal goods • Misleading listings • Off-platform transactions • Abusive or fraudulent behaviour Untagged may remove listings or suspend accounts.
User Content You retain ownership but grant Untagged a licence to use content for: • Platform operation • Marketing • Trust and safety You confirm content is lawful and accurate.
Verification and Trust & Safety Untagged may verify identity or request documentation. These checks do not guarantee user reliability.

Consumer Rights Nothing in these Terms removes statutory consumer rights under Irish or EU law.
Intellectual Property All platform IP belongs to Untagged. You may not reproduce or exploit it without permission.
Privacy Use of the Platform is governed by the Privacy Policy and Cookie Policy.
Disclaimers Untagged provides the Platform “as is” and does not guarantee: • Listing accuracy • Item quality • Transaction completion • Uninterrupted access
Liability Untagged is not liable for: • Indirect or consequential loss • Loss of profit • Actions of other users Liability is capped at: • Fees paid OR • €250 (whichever is greater)
Indemnity You agree to indemnify Untagged against claims arising from misuse of the Platform.
Termination Untagged may suspend or terminate access where necessary.
Changes to Terms Untagged may update these Terms from time to time. Continued use indicates acceptance.
Governing Law These Terms are governed by the laws of Ireland.
